Terms of Service

1. Acceptance of Terms

By accessing, browsing, or using any services provided by Hostao LLC, a Wyoming limited liability company ("Hostao," "we," "us," or "our"), you acknowledge that you have read, understood, and agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must immediately cease using our services.

We reserve the right to modify these Terms at any time. Changes become effective upon posting to our website. For material changes, we will notify registered customers via email at least 30 days in advance. Your continued use of our services after any modification constitutes acceptance of the revised Terms.

These Terms constitute a legally binding agreement between you and Hostao LLC. If you are entering into this agreement on behalf of a company, organization, or other legal entity, you represent that you have the authority to bind such entity to these Terms.

2. Services

Hostao provides web hosting (shared, business, and enterprise tiers), domain registration and management, VPS hosting, dedicated servers, reseller hosting, SSL certificates, email hosting, and related technical services. All services are subject to availability and governed by our Acceptable Use Policy.

We reserve the right to modify, suspend, or discontinue any service at any time, with reasonable notice to affected customers. Feature sets, storage allocations, bandwidth limits, and pricing are subject to change. Customers on existing plans will be given at least 30 days notice before any material changes affecting their active subscriptions.

Hostao does not guarantee that services will be uninterrupted, error-free, or free of harmful components. We undertake commercially reasonable efforts to maintain reliable and secure infrastructure, but customers acknowledge that no hosting service can guarantee absolute uptime or security.

3. Payment & Billing

All fees are due in advance at the start of each billing cycle. We accept major credit cards, debit cards, UPI, net banking, and other payment methods available through our payment processors (Razorpay and Stripe). Prices listed on our website are exclusive of applicable taxes unless otherwise stated.

Invoices are generated automatically and sent to your registered email address. Accounts with invoices unpaid for more than 7 days past the due date may be suspended. Accounts remaining unpaid for 30 days past the due date may be terminated and all associated data permanently deleted. Hostao is not responsible for data loss resulting from non-payment suspensions or terminations.

Recurring services will auto-renew at the then-current renewal rate unless cancelled before the renewal date. It is your responsibility to keep payment information current. Failed automatic payment attempts will trigger email notifications, and you will have a grace period of 7 days to update your payment details before suspension.

4. Refund Terms

Refund eligibility depends on the service purchased, billing cycle, setup work involved, and the active checkout or client-area terms presented at the time of order. Customers should review the current billing path for the applicable refund window, exclusions, and cancellation process.

Shared hosting, reseller hosting, VPS, dedicated servers, domains, certificates, licenses, and add-ons may each follow different refund rules. First-time purchases, renewals, upgrades, usage-based services, and custom infrastructure work should not be assumed to share the same refund treatment.

Where a refund is approved, the method, timing, and amount depend on the payment workflow, processor limitations, and the active service terms. Review our Refund Policy page as a general reference, and confirm the live billing terms before purchase or cancellation.

5. Acceptable Use

You may not use Hostao services for any illegal activities, including but not limited to: spamming or unsolicited bulk email, phishing or fraud schemes, distribution of malware or ransomware, hosting of copyrighted material without proper authorization, child exploitation material, illegal gambling, or any activity that violates applicable local, state, national, or international law.

Resource abuse that impacts other customers on shared infrastructure is prohibited. This includes cryptocurrency mining, running open relays or open proxies, excessive CPU or memory usage that degrades service for others, and denial-of-service attacks (whether originating from or targeting our network). We employ automated monitoring to detect abuse patterns.

Violations may result in immediate suspension or termination of your account without prior notice and without refund. Hostao reserves the right to cooperate with law enforcement authorities and to disclose information necessary to satisfy any applicable law, regulation, legal process, or governmental request.

6. Service Availability & Credits

Any uptime target, service-credit policy, or formal SLA applies only when it is explicitly included in the purchased service terms, proposal, or written service agreement. Different products and infrastructure arrangements may carry different availability expectations.

If a service-credit program applies to your order, the measurement method, exclusions, claim window, and maximum credit amount are governed by the active service terms for that product. Customers should not assume a universal uptime threshold or credit schedule across all Hostao services.

Where credit review is available, downtime caused by customer actions, third-party software, external attacks, DNS propagation, provider incidents, or events beyond reasonable control may be excluded according to the active service arrangement.

7. Backups & Customer Responsibility

Backup tools, automated backup options, and restoration workflows may be available on some services, but coverage, frequency, retention, and scope vary by plan, platform, and add-on configuration. Backup availability should not be treated as universal unless it is explicitly included in the active service terms.

Customers remain responsible for maintaining their own current copies of website files, databases, email data, and any other important content. Hostao cannot promise that any available backup copy will be complete, current, or suitable for every recovery scenario.

If restoration help or managed backup service is available for your plan, the request path, limits, and billing treatment depend on the current service arrangement. VPS and dedicated-server customers should confirm whether backup management is included or self-managed.

8. Intellectual Property

All content, branding, trademarks, logos, software, and documentation associated with Hostao and its services are the intellectual property of Hostao LLC and are protected by applicable copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any Hostao intellectual property without prior written consent.

You retain full ownership of all content you upload, create, or store on Hostao servers. By using our services, you grant Hostao a limited, non-exclusive license to store, process, and transmit your content solely for the purpose of providing the requested hosting services. This license terminates upon cancellation of your account and deletion of your data.

You represent and warrant that you own or have obtained all necessary rights, licenses, and permissions for any content hosted on our infrastructure. You are solely responsible for ensuring that your content does not infringe upon the intellectual property rights, privacy rights, or any other rights of third parties.

9. DMCA Policy

Hostao LLC respects the intellectual property rights of others and complies with the Digital Millennium Copyright Act (DMCA). If you believe that material hosted on our servers infringes your copyright, you may submit a DMCA takedown notice to our designated agent. Your notice must include: (a) a physical or electronic signature of the copyright owner or authorized agent; (b) identification of the copyrighted work claimed to be infringed; (c) identification of the material to be removed with sufficient detail to locate it; (d) your contact information; (e) a statement of good faith belief that the use is not authorized; and (f) a statement under penalty of perjury that the information is accurate.

Our designated DMCA agent can be reached at: Hostao LLC, Attn: DMCA Agent, Email: legal@hostao.com. Upon receipt of a valid takedown notice, we will expeditiously remove or disable access to the allegedly infringing material and notify the account holder.

If you believe your content was removed in error, you may submit a counter-notification including: (a) your physical or electronic signature; (b) identification of the removed material and its prior location; (c) a statement under penalty of perjury that you have a good faith belief the material was removed by mistake; and (d) your consent to jurisdiction of the federal court in your district. Upon receipt of a valid counter-notification, we will forward it to the original complainant and restore the material within 10 to 14 business days unless we receive notice of a court action.

10. Suspension & Termination

Hostao reserves the right to suspend or terminate accounts that violate these Terms, engage in abusive behavior, pose a security risk to our infrastructure or other customers, or fail to maintain current payment. Where possible, we will provide at least 24 hours advance notice before suspension, except in cases of severe or emergency violations requiring immediate action.

Upon termination, your right to access the services immediately ceases. We will retain your data for 30 days following termination to allow for retrieval, after which all data will be permanently deleted. If your account is terminated for cause (abuse, fraud, or repeated violations), data may be deleted immediately and no refund will be issued.

You may cancel your services at any time through the client area or by submitting a support ticket. Cancellation requests must be submitted at least 48 hours before the next billing cycle to avoid being charged for the upcoming period. Account data will be retained for 30 days post-cancellation unless you request immediate deletion.

11. Indemnification

You agree to indemnify, defend, and hold harmless Hostao LLC, its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to: (a) your use of our services; (b) your violation of these Terms; (c) your violation of any third-party rights, including intellectual property, privacy, or proprietary rights; or (d) any content you host, transmit, or store using our services.

This indemnification obligation will survive the termination or expiration of your account and these Terms. Hostao reserves the right, at its own expense, to assume the exclusive defense and control of any matter subject to indemnification by you, and you agree to cooperate with our defense of such claims.

12. Limitation of Liability

To the maximum extent permitted by applicable law, Hostao LLC's total aggregate liability for any claims arising out of or relating to these Terms or our services shall not exceed the total amount you paid to Hostao during the three (3) months immediately preceding the event giving rise to the claim.

In no event shall Hostao be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, loss of data, loss of business, business interruption, or loss of goodwill, regardless of the cause of action or the theory of liability, even if Hostao has been advised of the possibility of such damages.

Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability shall be limited to the greatest extent permitted by applicable law. This limitation of liability applies to all causes of action in the aggregate, including breach of contract, negligence, strict liability, and other torts.

13. Force Majeure

Hostao shall not be liable for any failure or delay in performing its obligations under these Terms where such failure or delay results from circumstances beyond our reasonable control. Force majeure events include, but are not limited to: natural disasters, acts of God, pandemics or epidemics, war or armed conflict, terrorism, government sanctions or embargoes, civil unrest, strikes or labor disputes, power outages, internet or telecommunications failures, cyberattacks (including DDoS attacks), and actions or omissions of third-party service providers.

In the event of a force majeure occurrence, Hostao will use commercially reasonable efforts to mitigate the impact and resume normal service as quickly as practicable. We will provide affected customers with timely updates regarding the status of service restoration. If a force majeure event continues for more than 30 consecutive days, either party may terminate the affected services without penalty.

14. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Wyoming, United States of America, without regard to its conflict of laws provisions. Any legal action or proceeding arising under these Terms shall be brought exclusively in the state or federal courts located in Wyoming, and you consent to personal jurisdiction and venue in such courts.

Before initiating formal legal proceedings, both parties agree to attempt resolution through good faith negotiation for a period of at least 30 days. If negotiation fails, disputes may be submitted to binding arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules. The arbitration shall be conducted in English and the arbitrator's decision shall be final and binding.

Notwithstanding the above, either party may seek injunctive or other equitable relief in any court of competent jurisdiction to prevent the actual or threatened infringement or misappropriation of intellectual property rights. The prevailing party in any legal action shall be entitled to recover reasonable attorneys' fees and costs.

15. Severability & Entire Agreement

If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it valid and enforceable, or if modification is not possible, severed from these Terms. The remaining provisions shall continue in full force and effect.

These Terms, together with the Privacy Policy, Acceptable Use Policy, and Refund Policy, constitute the entire agreement between you and Hostao LLC with respect to the use of our services and supersede all prior or contemporaneous communications, proposals, and agreements, whether oral or written. No waiver of any provision of these Terms shall be deemed a further or continuing waiver of such provision or any other provision.
